In this terms Boncart Retail Service Private Limited is mentioned as “Boncart”, a Company” “we”, “us” or “our”. We reserve the right, at our sole discretion, to change, modify, add or remove portions of these Terms of Sale, at any time without any prior written notice. You are requested to regularly visit the homepage www.Boncart.com to view the most current Terms of Sale, for further more update refer to Terms of Use and policies at our homepage all those terms are also applicable.
All the materials and products and services, included on or otherwise made available to you through the website shall be covered by standard product warranty offered by the manufacturer.
Nothing on this website constitutes, or is meant to constitute, the advice of any kind and you are requested to perform independent analysis before ordering the products.
Order & Payment
Due to GST, the price of product you place will change. Acknowledgement will be sent at the time of product confirmation. As soon as we dispatched your order you will receive the invoice through separate mail where you can track your Invoice number. This will prevail only for short period.
Unless credit terms have been agreed by Boncart in written consent, payment should be made in full including taxes for products or services before the physical delivery of products or services.
The customer shall bear Taxes as applicable.
Time is of the essence with respect to payment. Boncart reserves the right to charge interest at the rate of 24% per month from the date on which the payment was due till the date of actual receipt of payment.
Unless Customer and Boncart have agreed to a different discount, Boncart's standard pricing policy for all products, which include both hardware and services in one discounted price, allocates the discount off list price applicable to the service portion of the system to be equal to the overall calculated percentage discount off list price on the entire system.
Boncart values each and every customer a lot, customers are classified into 4 categories and customers under each category has their own special benefits and offers for their order. All offers, discounts and special benefits are applicable to default customer, few offers, discounts and special benefits may vary or some may not be totally applicable for customers who are categorized as dealers, there might be a small change in price for reseller, Premium customer is an existing off store customer, they are categorized into premium according to their long term, quality and volume of business they do in off store.
The above said category name may change or it may be increased or decreased or the said price priority may differ. These changes will happen according to time to time with or without any information. We may also degrade the customer category if there is any change in internal policy or due to any other issues.
Software
All software provided is subject to the terms and conditions of the license agreement relating to that software. Customer acknowledges its obligations to abide by such license agreements. Customer acknowledges that Boncart does not warrant any software under these Terms and Conditions.
Delivery
Boncart shall deliver the Products to the place of delivery confirmed by Customer and agreed by Boncart. Boncart may deliver the products by instalments in any sequence at its own discretion. Where the Products are so delivered by instalments, each instalment shall be deemed to be the subject of a separate contract and no default or failure by Boncart in respect of any one or more instalments shall void the Contract in respect of Products previously delivered or undelivered Products. Dates quoted by Boncart related to products, services and payments process are approximate only and shall not form part of the contract. Boncart shall not be liable for any delay in the specified date however caused. Products at Boncart may be revised or discontinued at any time without any prior notice as part of Boncart's policy of on-going product up-date and revision. Revised or updated products will have the functionality and performance of the Products ordered. The customer accepts that the specification of the delivered product may result in difference with the product ordered. There may be occasions when Boncart confirms orders but learns that it cannot supply the ordered Products, either at all or in the quantities ordered such as when the products no longer are being manufactured or they otherwise become unavailable to Boncart, or when Boncart cannot source components for the configuration ordered, or when there is a pricing error etc. In such circumstances, Boncart will contact the customer to inform them about alternative products that might meet the customer's needs. However, if the customer does not wish to order alternative products, Boncart will cancel the order for Products that it cannot supply and will refund your purchase price for those products.
Store Pick Up
Customers can also waive off your shipping price with this easy Store Pick Up option. Store pick up in Boncart is that you can order a product through online and you can collect it in person by walking into our store. But the payment for the product should be done through online. Once your order is ready, we will send you a Code Number through SMS or Email and this code number should be produced at the time of collecting your order. You can collect your order within 7 business days from the day you received the Code Number. You are advised to carry your order number and a valid ID proof like Voter ID card, Pan Card, Aadhar Card, Passport etc, along with the received Code Number to collect your order. If the customer sends the alternate person to receive the order then the person who placed the order should contact our customer care executive or mail to sales@boncart.com through the registered phone number or Email address about the alternate person’s Name and Contact No or a new code number will be resent to the registered phone number or Email address after that alternate person reaches our place and that should be produced to receive your order. For better security we advise the customer to collect the order. If customer requires packing it may delay in minutes for us to give your order and it is your responsibility to check your product before you take it out from our place, we are not liable for complaints raised after taking the product away from our place. We suggest you to call our agent at sales team before collecting the order. You can walk in to our store at any time between 10AM to 5PM excluding lunch hour(1:30PM to 2:30PM)and Government holidays and Sundays.
Acceptance of Products
Unless the customer notifies Boncart about the contrary of the product on the day of delivery and such notification is confirmed in written within two days, the products shall be deemed to have been accepted by the customer in good condition and it is in accordance with the contract. Customer shall not be entitled to withhold payment of all or any of the price of the products whilst any claim is being investigated by Boncart.
New products purchased under these Terms and Conditions directly from BONCART should be returned within 10 business days after the invoice for replacement, refund or credit of the purchase price in accordance with Boncart’s “Return Policy”. The refund or credit will not include (a) any shipping and handling charges forming part of the purchase price and (b) any Octroi tax amount. Products returned under Boncart’s return policy must be in the same condition as shipped by Boncart, including conformance to invoiced specification, and all of the manuals, diskettes, CDs, power cables and other items included with a Product must be returned with it.
Warranty
Unless specified otherwise, Boncart warrants that Boncart- branded products will be free from defects in materials and workmanship affecting normal use for a period of one year or such other period as may be set out in Boncart's invoice. Standard Warranty or Relevant Warranty does not cover damage, fault, failure or malfunction due to external causes, including accident, abuse, misuse, problems with electrical power, servicing not authorized by Boncart, usage and/or storage and/or installation not in accordance with Product instructions, failure to perform required preventive maintenance, normal wear and tear, act of God, fire, flood, war, act of violence or any similar occurrence; products with missing or altered Service Tags or serial numbers; any attempt by any person other than Boncart personnel or any person authorised by Boncart, to adjust, repair or support the Products and problems caused by use of parts and components not supplied by Boncart. The Standard Warranty or Relevant Warranty does not cover any items that are listed in the following categories: software, external devices, accessories or parts added to the Product after the Product is shipped from Boncart, accessories or parts added to the Product through Boncart's Custom Factory Integration (CFI) program, accessories or parts that are not installed in the Boncart factory, or Third Party Products purchased under Boncart Software & Peripherals (S&P) Program. Boncart will repair or replace Boncart-branded Products returned to Boncart's facility at its option and to the extent permitted by law. Customer must prepay shipping and transportation charges, and insure the shipment or accept the risk of loss or damage during such shipment and transportation. Boncart will ship the repaired or replacement Products to Customer freight prepaid. Boncart does not give any warranty that the Products are fit for any particular purpose and this Standard Warranty is given in place of all warranties, conditions, terms, undertakings and obligations implied by statute, common law, trade usage, course of dealing or otherwise including warranties or conditions of merchantability, fitness for purpose, satisfactory quality and/or compliance with description, all of which are hereby excluded to the fullest extent permitted by law. To the extent permitted by law, the Standard Warranty and remedies set forth herein are exclusive and in lieu of all other warranties, remedies and conditions, whether oral or written, statutory, express or implied. If Boncart cannot lawfully disclaim Statutory or implied warranties then to the extent permitted by law, all such warranties shall be limited in duration to the duration of this Standard Warranty and to repair or replacement service as determined by Boncart in its sole discretion. No Boncart reseller, agent, or employee is authorized to make any modification, extension, or addition to this warranty.
Third Party Products
The customer agrees that the product purchased from the third party through Boncart are covered by a relevant manufacturer’s warranty, the standard warranty shall not extend to such Third Party Products and such manufacturer's warranty shall be the sole warranty in respect of such Third Party Products. The customer shall utilise the relevant manufacturer warranty for the warranty support of Third Party Products. Boncart in so far as permitted by law provides Third Party Products "as is".
Liability
The liability, if any, of the service provider and Boncart towards a user under this agreement shall be limited to the amount payable by the user to the service provider. Either service provider or Boncart shall not be liable for any indirect special or consequential costs or failure of any functionalities, software, products, related graphics arising out of the use of the website, products and/ or the services and/ or the agreement or with the delay or inability to use this Website, or for any information, materials and/ or products uploaded, posted, emailed, transmitted and/ or obtained through this website whether based on contract, tort, negligence, strict liability or otherwise. This provision does not limit either party's liability for: unauthorized use of intellectual property, nor any liability which may not be excluded or limited by applicable law.
Indemnify
The Customer shall indemnify Boncart and hold harmless Boncart from any and all costs, losses, claims, demands, damages to any property or injury to or death of any persons caused by any negligent act or omission or wilful misconduct of the Customer, its employees, agents or sub-contractors or by any breach of its contractual obligations arising out of these Terms and Conditions.
Any party to the contract shall not be liable for any delay in performing any of its part to the contract under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of the party so delaying, and such party shall be entitled to a reasonable extension of time for the performance of such part of contract.
Waiver: Any failure by Boncart to enforce or exercise any provision of the Terms of Sale, or any related right, shall not constitute a waiver by Boncart of that provision or right.
Service and Technical Support
Boncart will provide service and technical support to customer in accordance with the then-current service and technical support policies in effect. Service and support offering may vary from product to product. Boncart provide the optional service and support to customer according to the purchased optional service and support packs in accordance with the then-current terms and conditions in the optional service contract between Boncart and Customer. Boncart at its own discretion may revise its general and optional service and support programs and the terms and conditions that govern them. Boncart has no obligation to provide service or support until Boncart has received full payment for the Product or service/support contract for which service or support is requested.
Service
To the extent permitted by law customer agree that Boncart will not be liable for products that are not being available for use, or for any corrupted, deleted, altered and loss of data and software. Any service response times stated by Boncart in service contracts are approximate only. Boncart shall not be liable to the Customer for a) any incidental, indirect, special or consequential damages, b) loss of opportunity, c) loss of revenue, d) loss of profit or anticipated profit, e) loss of business f) loss of contracts, g) loss of goodwill, h) loss arising out of business interruption, i) loss arising out of or in connection with pollution or contamination all arising out of or in connection with the purchase, use or performance of Products or services, even if Boncart has been advised of their possibility. To the extent permitted by law, any typographical, clerical or other error or omission in sales literature, quotation, price list, acceptance of offer, invoice or other documents or information issued by Boncart shall be subject to correction without any liability on the part of Boncart.
DOA
A product having hardware failure due to manufacturing defects within a period not exceeding 10 business days from the date of invoice and if it is not repairable then it will be treated as DOA. In the event of a DOA, the customer should contact manufacturer’s authorised service center. The first attempt shall be to repair and restore the product.
In order to claim DOA the following aspects are taken into account:
In case you notice the package contents missing or find physical damage while unpacking (dents, bumps, cracks, leakage of fluid, scratches) you should immediately contact the Manufacturer’s authorised service center and arrange for sending the equipment back to the designated location
Definition:
"BONCART-branded" means computer hardware products that are marked with the "BONCART" brand, including all standard components thereof, but does not include any of the following items:
"Order Confirmation" means formal acknowledgement of Product ordered by Customer, sent by BONCART.
"Price" means the price as per BONCART Quotation and Order Confirmation and the latter shall have precedence.
"Product(s)" means the products as described in Order Confirmation and may include BONCART-branded products, third party products and Service Offerings
"Service Offering (s)" means the different service options offered by BONCART for the Products or any part of them and for varying periods, as described in BONCART's published literature, including but not limited to BONCART's Invoice and/or BONCART's Service
Description
"Third Party Products" means products other than BONCART-branded.
"Contract" means a contract for sale by BONCART to the Customer of the products and/or services incorporating the Terms and Conditions
No Contract shall come into existence until the Customer's order has been accepted by BONCART by way of confirmation e-mail from BONCART
The Products sold and/or services rendered are subject to these Terms and Conditions to the exclusion of any other terms and conditions stipulated or referred to by Customer. The Customer acknowledges that it is aware of the contents of and agrees to be bound by these Terms and Conditions. Neither BONCART's acknowledgment of a purchase order nor its failure to object to conflicting, different, or additional terms and conditions in a purchase order shall be deemed an acceptance of such terms and conditions or a waiver of the provisions hereof.

The following describes the User Agreement between the Boncart Retail Service Private Limited and the user/registrants of the website. Your use of the website or the services provided by the website shall signify Your acceptance of the Terms of Sale and Your agreement to be legally bound by the same. Payment
The payment for the Products or services including applicable taxes shall be made in full before physical delivery of products or services. The Services shall be made available on a chargeable basis depending upon the subscription plan chosen by you, from amongst the following. Each plan allows the user to avail Services with respect to a single computer only. We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the pre-set limit mutually agreed by us with our acquiring bank from time to time.

Suspension Of Services
Boncart reserves the right to modify or discontinue the services either temporarily or permanently and refuse any and all current and future use of the services, suspend or terminate your account or use of the services and remove and discard any of your content in the Services, for reasons such as unauthorized access of our portal, servers and databases, abusive behaviour, data theft, improper utilization of our Services etc. Such termination of the service will result in the deactivation and/or deletion of your account.
Data Backup
You are solely responsible for maintaining and backing up all information, data, text or any such materials and software stored on your computer and storage media before booking the services. You acknowledge and agree that BONCART.COM or its third parties has no responsibility or liability under any circumstance at any time for any loss or corruption of customer data, software or hardware that may arise out of the services.

No advice or information, whether oral or written, obtained by you from Boncart or through or from this site shall create any warranty by Boncart. Governing Law
The transactions on this website shall be governed by and enforced in accordance with the laws of India. Any performance, damages and other disputes arising in respect hereto shall be subject to exclusive jurisdiction of the Coimbatore court.
Waiver: Any failure by Boncart to enforce or exercise any provision of the Terms of Sale, or any related right, shall not constitute a waiver by Boncart of that provision or right.
FOOD TERMS
Order
You agree and warrant that the details furnished by you while ordering are complete and accurate. The products at our food store are suitable for certain age ranges only. Before you place an order ensure that you are ordering the suitable product. Order that you place on our site is completely subject to products availability. Your order will be processed once the provided details are confirmed correct. You will be asked to sign in to place the order, please furnish the right details. We will take all necessary care to keep the details of your order and payment secure.
Pricing
We strive to ensure the price of the products are correct and up-to-date. Time to time, the price of few products may not be the current update or it may be an incorrect price due to some typographical, informational, technical errors or might be the incorrect product information provided to the Company by a supplier. In each such case, notwithstanding anything to the contrary, the Company and the seller both reserve the right to cancel the order without any further liability. Customer receives the product with the same price that was mentioned at the time of ordering the product.
Payment
Boncart makes your purchase easier through various payment methods. The online payment mode through payment gateways ensures to keep your transaction confidential.
We also accept Visa, MasterCard, Maestro and American Express credit/debit cards payment in India and 21 other countries.
The price which reflects on the product page is final and that is what you exactly pay. Hence there are no hidden charges for your purchase.
Delivery
The prescribed delivery period at the time of ordering may vary. The package will be couriered to the specified address at the time of ordering. The order placed will be delivered by a reputable courier. If you are not at the specified address to receive the Package at the delivery time or if we are unable to locate your place due to your failure to provide correct instruction, then such goods are considered to be delivered to you and all risk and responsibility related to such goods shall pass to you. You are fully responsible for all the storage, insurance, and other costs we suffer due to your inability to accept the order. Ordered products should be received by the customer during the first attempt of courier itself. If the goods get rotten while you postpone the delivery to the second attempt shall not be returned.
Cancellation
You as a customer can cancel your order any time before you receive the order confirmation mail or SMS from Boncart. In such cases, we will refund any payments already made by you for the order. In cases, we may also cancel your order when we unable to fulfil your order and We will also cancel the orders that placed from long-distance regions because the fresh food goods may decay due to long-distance shipping. If we suspect any fraudulent transaction by any customer or any transaction which defies the terms & conditions of using the website, we at our sole discretion could cancel such orders. We will maintain a negative list of all fraudulent transactions and customers and would deny access to them or cancel any orders placed by them.
Colors
We have put our effort to display the colours of our products which appear on the Website as accurately as possible. But still the display of the actual colour depends on your monitor, we cannot guarantee that your monitor's display of any colour will be accurate.
Return & Exchange
Return and exchange are accepted in case of a faulty product or a different product is delivered. In such cases, delivery charges will be borne by Boncart.
General
We may modify the Terms and Conditions at any time without notice to you.
Payment must be made either at the time of ordering the product from us by credit card or at the time of delivery by cash. Failure to pay on time will result in the cancellation of your order.
The Terms and Conditions together with the Privacy Policy, any order form and payment instructions constitute the entire agreement between you and us. No other terms whether expressed or implied shall form part of this Agreement. In the event of any conflict between these Terms and Conditions and any other term or provision on the Website, these Terms and Conditions shall prevail.
If any term or condition of our Agreement shall be deemed invalid, illegal or unenforceable, the parties hereby agree that such term or condition shall be deemed to be deleted and the remainder of the Agreement shall continue in force without such term or condition.
These Terms and Conditions and our Agreement shall be governed by and construed in accordance with the laws of India. The parties hereto submit to the exclusive jurisdiction of the courts of Coimbatore.
No delay or failure on our part to enforce our rights or remedies under the Agreement shall constitute a waiver on our part of such rights or remedies unless such waiver is confirmed in writing.
We reserve the right to refuse service to anyone for any reason at any time.
GARMENT TERMS
Order

Tees sold in Boncart are good in quality made out of 180 GSM combed cotton and the tees are brought for customer view only after undergoing the following process

Colours
We have made every attempt to display the colour of the garment products as accurately as possible. However as the display screen varies, we cannot guarantee that your monitor’s display of any colour will be completely accurate.
Exchange
If your T-shirt is defective or if we sent you the wrong size or if we sent a different T-shirt by mistake, let us know within 10 days of receiving.
We will gladly replace or refund any product within 10 days from your purchase. We will not accept refund or replacement or products that are bought through coupon code or discount. User is responsible for return shipping unless the item is found to be defective.
We will accept returns/exchanges which are unworn, unwashed and should be attached with all tags along with corresponding receipt. Where provided belts and additional add-on should be included with your return.
Refund
If you receive the confirmation mail from us regarding your refund request it is assured that we have initiated your refund request and are following up with financial organizations for the same. Sometimes financial organizations take a longer time to process the refund request. However, if the refund hasn't happened by the date we promised, you can contact us. We will gladly help you. If a gift wrapped product is returned or cancelled then the product cost alone will be refunded, the cost of the gift wrapper cannot be refunded.
While returning the product ensure it has the same packaging and also you have attached all the invoice copies and all accessories, manuals, etc related to that product. If it is not returned with original packaging then the refund may vary product to product.
The refund may be given as a cheque in the name that user shared with boncart accounts. So the user should give proper name as in the bank account / statements. If You have done the payment through any visa, debit or credit cards refund will be done to that card through the payment gateway.
If you have paid using net banking or credit/debit card, your refund will be initiated with your bank shortly. Your bank may take 2-4 business days for net banking purchases and 3-5 business days for credit/debit card purchases to credit the refund amount to your account. Please note that if you paid through EMI on Credit card, this refund may cause a change in the terms of your EMI with your credit card issuer, and the issuer might levy a charge for this EMI cancellation. Please check with your credit card issuer on how your EMI may be affected but if you have paid through Gift Card, your Gift Card balances will be credited to your Boncart Account.
USED PRODUCTS
Order & Payment
The products under old market will be in enquiry mode, leave your details for the interested product for our sales team to contact you and once you received the mail from sales@boncart.com or call from our sales team, customers who are interested can walk into our showroom to purchase your product. You are responsible for validating the condition of the item before taking the product from our place. Once accepted, the item can't be returned or replaced. Customer shall bear Taxes as applicable.
Product
Actual product may vary from the product category, Image, description, color, size, etc. of a product as displayed on the website. It is customers responsibility to check the product specification, colour, quality, size etc before you take away the product from our store. Customers are advised to exercise caution and commercial prudence and satisfy themselves by conducting independent enquiry regarding all aspects of any product listed on the website.
Store Pick Up
The old market products can be bought through an option called store pick up where you can collect it in person by walking into our store. Payment details will be given while you are visiting the store directly. Boncart’s decision is the final in quoting the price for used products. The time period to collect your order is fixed based on the mutual understanding between customer and Boncart, but the maximum time period to receive your product is 48hours from the day you receive the call or mail from our sales team. If the customer requires packing it may delay in minutes for us to give your order and it is your responsibility to check your product before you take it out from our place, we are not liable for complaints raised after taking the product away from our place. We suggest you to call our agent at sales team before collecting the order. You can walk into our store at any time between 10AM to 5PM excluding lunch hour (1:30PM to 2:30PM) and Government holidays and Sundays.

Force Majeure
Any party to the contract shall not be liable for any delay in performing any of its part to the contract under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of the party so delaying, and such party shall be entitled to a reasonable extension of time for the performance of such part of contract.
Waiver: Any failure by Boncart to enforce or exercise any provision of the Terms of Sale, or any related right, shall not constitute a waiver by Boncart of that provision or right.
